McGill: A police state?

that one day when tlu.l' entered her office, seizing files, searching
through her computer account and charged her with being a "threat to
the integrity of the community. The sr1bsequent trial was a farce; she
was guilty rmtil proven innocent. Illegally obtained evidence, violations of basic rights to privacy and no chance of appeal as she was
convicted ami her life destroyed.

An Orwcllian vision of the future? Military dictatorship? A bad
movie plot? Or McGill 1994?
The above scene could well happen at McGill iflrwin Gopnik,
Dean of Students, has his way. At last Wednesday's Senate meeting,
Gopnik proposed revisions to the code of student conduct. Revisions which show some of the most draconian attitudes of the
McGill administration.
The code of student conduct governs what is and what is not
good behaviour for students, and outlines the procedures for
hearings when a student is charged with an offence.
Some of the proposed revisions to the code include:
·Eliminating the confidentiality of communications made
through the university's computer system, including electronic
mail.
·Allowing administrators to use illegally obtained evidence
during hearings.
•In cases of plagiarism the student would be presumed guilty
notwithstanding Article 22 of the Charter of Student Rights which
states that a student is innocent until proven guilty.
•A student could be suspended for up to 30 days on the whim of
the Dean of Students (an increase of IS days) before the student
could appeal the decision.
·A student cannot have a lawyer present during the hearings.
These changes are in violation of our legally established right to
privacy, as well as contradicting the Charter of Students' Rights.
Section I of the Fundamental Rights and Freedoms section of
the Charter states that "Every student enjoys within the University
all rights and frccdoms recognized by law."
Rights and frecdoms recognized by law include the Quebec
charter of human rights, which states that everyone has a right to
privacy (violated by McGill's insistance on the right to search
private computer accounts), and that illegally obtained evidence is
not admissable.
The proposed code is coming up for debate at Senate in the fall.
The university community must choose whether we will be governed through a climate of fear, or strive to live in a community
which respects basic human rights.

Pixels at an Exhibition

Almost one month has already
flown since then. But I can still remember 75 booths that could have
driven one mad. The South Hall of
Place Bonaventure had been hosting the fourth edition of Micro
Expo, March 18-20, 1994.
At that time, I knew several people who had chosen not to attend
this major computer show. Just to
preserve their mental health. If I
myself was not among them, this
was because I attended the Expo as
a staff member of the MSR Foundation for Special Causes. Which does
not necessarily involve that I'm still
sane.
Of course, the sacred monsters
ofthecomputcr market were major
attractions for the visitors. Virtual
reality applications also enjoyed
large scale interest. Therein, kids of
four, and over, became parts of various dynamic landscapes. But I bet
that the best educational shareware

of this show was provided by wargames performed on large screens.
As for our team, the aim was to
gain interest in, and, why not? computer support for, a multimedia
project to help dyslexic people.
Whether the original goal was accomplished, it still remains to be
seen. But at least we toured ourselves the Expo.
Thereby, I discovered some very
interesting booths. They had nothing particularly to do with a computer show.Onlyscarcelycould one
find any computer stuff on their
desks. Boy, and those booths were
not that crowded insideashowours
was!
It seems to me that the ones who
simply assaulted the Expo, on its
very first day, included the genuine
hackers. Whereas the exhibition
looked more like a promenade
(thank you, Mussorgsky!) during
its second day. 'Jt is not accurate,

however, for me to extend this evaluation to the third day as well. Because I did not refrain from taking
a necessary break for some hours.
Thus, I attended my very first St.
Patrick's Parade since I have been
here.
When it all was over, everyone
concurrently acted to dismember
and pack everything that had been
the show. My head was still tormented with images of the vivid life
therein. I was wondering what kind
of an Expo would be the next one.
But for me, this one was not the
crucial query, however .It was rather "what to do next?." One cannot
be a volunteer, as I had been with
MSR, for one's lifetime. Obviously,
once the Micro Expo finished, I was
not to lookanymorefor Carol from
MCJ Library. Just to share a cigar &amp;
coffee break, and some bla-bla-bla
impressions.

ERRATUM
On page 5 of the final Culture Issue (Temporary Settlers: A Critical Look at Tourism), in the comment
entitled "Whose Paradise Is This Anyway?", we accidentlyattributed the practice of using dogs to chase Arabs
off the beaches to Jerusalem. This is done in Tunisia, not Jerusalem. And anyway, there are no beaches in
Jerusalem, since it's landlocked.

Code from the Dean's office. Council only saw this document last
Wednesday, and the document I
brought to council [was in] bits and
pieces from the secretary," said
White.
"I believe this code is stiJI very
much in its rudimentary stage,"
noted Wong. "For example, ... the
VP University Affairs and the Political Research Officer of the Students' Society have put together 13
major amendments plus 27 smaller amendments to this document."
Gopnik said he felt that further
consultation is not necessary.
"I have a great deal of sympathy with the student problem in that
they [student reps] turn over every
year," Gopnik commented, adding,
"I dare say that 80 per cent of the
wording in this [document] originated from students last ye.tr."

Noumoff said he felt that each
year's Students' Society administration may have some differences in
opinion every so often, and so they
should have been consulted before
Senate.
"Let us go through the process
which recognizes that, with each
generation, things do change, and
that we are more permanent. But
we can't use that to muscle in the
proposal," the professor commented.
Senate only managed to reach
section 19 of the code, which had
revisions up to section 88, when
time elapsed for discussion in the
'committee of the whole'. After this
period, Gopnik moved that Senate
accept the document.
Faculty of Arts Senator Leanore Lieblein moved that the document be tabled to a future date and
it was voted that Senate postpone
acceptance of the document until
the Nove;nber 23 Senate meeting so
that the students may voice their
concerns.
Dean Gopnik has already organized another meeting to diswss the
CodeofCondrtct or1 November 16 at
14h30 in Lencock room 232. The
meeting will be open to the public.

The Dawson College Media
Council recently voted to shut
down student newspaperThe Plant
after its editors refused to allow
Council and administration representatives to inspect the newspaper
before going to print.
The November 10 decision came
a week after The Plant ran a cover
photo of a naked man with an erect
penis, holding a condom .. Michelle
Clabrough, Dawson's head of student services, pulled the issue for
fear of being sued. Following this,
the Media Council, which is made
up of Dawson students, voted to allow re-distribution of the issue only
if the offending phallus was painted over in black.
On November 4, the Media
Council issued the paper an ultimatum, ordering the editorial board to
allow an advisor from the administration and a media council representative to look over the entire
paper before going to the printer.
The Plant refused to comply
with this ultimatum. In response,
the Media Council voted 2-1, with
three abstentions, to close down the

paper.
Sean Garrety, editor-in-chief of
The Plant, speculated that the paper was not the real issue.
"The issue is, more or less,
'Who's running whom?"' he said,
adding, "I know who it is, and it's
Dawson. When it comes to legalities, they are going to be very anal."
Lauren Kisilevsky, a Media
Council member, said that a Board
of Governors (BoG) representative
advised them that the BoG was already considering action. She added that the Council mistook this
person's opinion for fact.
"We were told that if we didn't
do something that strong, that The
Plant would be closed down forever," she explained.
Richard Blake, another member
of the council, apologized for the
mistake, admitting, "We did not
look into the whole thing thoroughly."
Clabrough commented that the
authority of the media council to
shut down the paper is "questionable," and that its constitution does
not make a direct reference to it.

The media council,
Clabrough and the editorial board of the paper met to find a shortterm solution to the
conflict after Plant
staffers were locked out
of their offices.
In the end, they
agreed that representatives of the council, the
Board of Governors
and The Plan twill meet
to review the final four
issues of the paper this
semester after they are
printed, but before distribution.

"I'm sure Vice Principal [ofPianning and Resources] Francois Tavenas wanted to start instituting the
policy by September," said former
studentsciencesenatorArnold Kwok,
who was present during the meeting.
"I thought that by doing so [Tavenas] might have stifled some discussion in the Senate. As a result, there
was hardly any student response."
Tavenas was responsible for chairing the sec. The first draft of the
policyhadbeencirculatedinthesummerofl993andhasseenmuchinput
from students, academics and administration.
The MCF policy consists of three
documents: the code of conduct for
users of the MCF, an interpretation
document for the users' code of conduct, and the managers' guidelines,
which describes what systems managers have the power to do.
Throughout the document, the
draftersofthecodetooktheadviceof
the McGill community, and tried to
ensure that users' rights are protected without compromising system
security. The managers' guidelines
clearly states this in section 2.1.4.
"Systems managers must respect
privacy as specified in the MCF Code
ofConduct, unlessotherwiseallowed
by the policy," it states.
Most questionable actions, such
asdenial ofaccess to McGill computers or the inspection of data, require
the permission of a higher authority,
such as a supervisor or a special au-

systems manager for the McGill Computer Research Centre for Intelligent
Machines. "Know the last time the
directory was modified, and compare it to the new time. Basically
there are three ways to check ifsomething has happened: modification
time, access time, and creation time."
To check your modification times
on MUSIC, you can choose option
four in the menu commands to display a full screen directory listing, or
you could type in "library • f' at the
command line. UNIX users will need
to use the command "Is -1" option to
show the times.

There are, however,
many problems that
still exist besides problems with computer
privacy.
In section 15bofthe
code, a student's right
to be presumed innocentWltilprovenguilty
has been suspended:
"...itshallbepresumed
that the student intended to deceive; the
student shall bear the
burden of rebutting
this presumption by
evidence satisfying the
person or body hearing the case that no intent existed ..."
Yet, in the Charter
of Students' Rights it
states that: "Every student enjoys within the
University all rights
and freedoms recognised by law." This ineludes the right to be
presumed innocent until proven
guilty.
The Charter is also broken in another sectioQ, which describes the
adrnissability of evidence: "the rules
of evidence applicable in civil and
crimianl court proceedings shall not
apply to the hearing. Evidence which
is not relevant or is only remotely
relelvant shall be excluded."
Evidence that has been obtained
illegally can be included in the hearing depending on whether or not the
evidence is related to the 'trial'.
"If[ university officials] do illegally read through your e-mailletters,
forexample,andsubmitit, [the members of the hearing] would be able to

look at it," said Small. "Something
like that I would think would be unacceptable... Most people, not just
the law senators, would cringe at that.
As an aside at the last Senate meeting,
a lot of the academics and the other
senators shared many of the concerns of the students."
"Basically, there are two types [of
evidence] which will be considered
to be excluded," said Kwok. "This
SOWlds perfectly straight forward to
me, but at least by appearance the
Chair and the legal assessor will rule
on what evidence will be admissable
or not; whereby, there is little input
on the student's part."

that: "A student so accused [of misusing McGill's computing facilities]
may not claim that communications
made through the University cornput er system are confidential..."

Committee on Computing had finalized what they were going to do,"

"I think most people would agreeitis
extremely impractical, unecessary
and a little absurd to have two parallel but different codes."

have been compromised. Unless one
is a sharp law student, one may not
realize that some of the evidence presented in the trial is only obscurely
pertinant. For many students, a lawyer would be an ideal person to have
present during the proceedings.
Unfortunately, lawyers have been
barred form the proceedings according to section 30 of the Code: ".. .advisors must be members of the University community, and must not be
paid for these services, nor may they
be a member of any bar."
Small criticized this restriction.
"The hearing itselfisvery stressful
on the student," she stated. "It is very
intimidating walking into that room
and presenting yourself. Even ifyou're
really sure of yourself, it's very hard •
on someone. I think it would be nice
to have someone there to argue for
them."
Amuch larger cause for concern
is in section 55 where: "... [the Dean
of Sutdents] may suspend the student for a period not exceeding 30
days(exarninationsmissed or papers
not submitted because ofsuspension
shall be counted as unexcused absenses or lateness..."
"Honestly, a third or two thirds of
a student's semester has been ruined," said Small "It's not even the
time they've wasted waiting for this
trial, it also costs a lot ofmoney to pay
for a whole bunch of courses that
you're not allowed to attend."

e jeudi 10 janvier dernier, l’Association Étudiante de l’Université
McGill (AÉUM) a tenu son premier conseil législatif de la session d’hiver
2013. Figurait sur l’agenda en particulier
l’invitation devant le conseil du doyen de
l’Université McGill Anthony Masi, venu
faire un compte rendu de l’année 2012 et
une présentation des objectifs de l’administration pour l’avenir. Au programme
était aussi la motion présentée par Robin
Reid-Fraser, VP externe de l’AÉUM, et
Devin Bissky Dziadyk, représentant des
sciences, concernant la tenue d’états
généraux sur l’éducation supérieure du
Québec.
Compte rendu du Doyen
Le doyen de l’université Anthony
Masi a commencé son compte rendu en
répondant aux questions des membres
du conseil à propos de l’administration
et des réformes de l’année précédente.
Masi a ensuite évoqué les difficultés
rencontrées cette année concernant
la prévision du budget, car les fonds
supplémentaires
alloués
par
le
gouvernement Charest dans le cadre de
la hausse des frais de scolarité ont été
coupés deux fois par ce dernier, avant
d’être définitivement annulés par le
gouvernement Marois. Sur ce, Masi s’est
plaint que «le financement irresponsable

du gouvernement [provincial] est au
moins partiellement responsable du
déficit auquel nous faisons maintenant
face», et que «bien que le Québec ait
fait de bonnes choses pour l’éducation,
ses
universités
sont
maintenant
sous-financées». Le déficit actuel de
l’université s’élève s’élève selon lui aux
alentours de 88 millions de dollars.
Masi a ensuite dévoilé les objectifs
de l’administration destinés à faciliter
sa mission, à savoir «faire progresser

l’acquisition de connaissances par
son enseignement, par ses travaux de
recherche et par les services qu’elle
rend à la société», selon le site Internet
de l’université. Ces derniers comprenaient,
entre autres, l’embauche du nouveau
premier vice-président exécutif adjoint
mais aussi le développement de McGill
Innovative
Learning
Environments
(MILE). Le but de cet organisme sera
de restructurer les espaces d’études à
McGill, en particulier les bibliothèques,

dont les espaces utilisés pour les livres
écrits pourraient être réaménagés au
profit de l’acquisition de plus de livres
électroniques. En effet, selon le Doyen:
«Près de la moitié des livres écrits dans la
bibliothèque McLennan ne sont jamais
empruntés», ajoutant que cet espace
pourrait être utilisé à d’autres fins.
Motion concernant le sommet sur
l’éducation supérieure
Suite au compte rendu du Doyen
et quelques motions concernant la
législation de l’AÉUM, un débat a été
ouvert concernant la motion de Robin
Reid-Fraser et Devin Bissky Dziadyk, qui
stipulait la demande par l’AÉUM d’états
généraux sur l’éducation supérieur,
à travers la Table de Concertation
Étudiante du Québec (TaCEQ). Selon
Reid-Fraser, «nous allons à ces rencontres
[de la TaCEQ] sans vraiment savoir ce
que nous voulons».
Des états généraux fourniraient
donc une plate-forme nécessaire aux
discussions afin de bien représenter
les désirs des étudiants au Québec
concernant l’éducation universitaire.
Ils permettraient selon la VP externe
de faire un examen complet du système
universitaire afin d’arriver préparé au
sommet sur l’éducation supérieur prévu
par le gouvernement provincial en février
prochain. Après un long débat au sein du
conseil, la motion à été reportée à plus
tard. x

lors que le Code de conduite de
l’étudiant de l’Université McGill
s’apprête à être révisé, les modiﬁcations qui y seront apportées continuent à faire couler de l’encre. Un étudiant de l’université, Eli Freedman, a
décidé d’aller jeter sa colère sur papier
en déposant un grief contre ce Code de
conduite en voie d’être modiﬁé.
Eli Freedman était présent lors de
la manifestation du 10 novembre 2011
en marge de l’occupation du bâtiment
James. «C’était un jour dramatique pour
plusieurs étudiants alors que la police
est inter venue lors d’une manifestation pacifique», explique-t-il. Après une
manifestation ayant eu lieu dans la ville
de Montréal contre la hausse des frais de
scolarité annoncée par l’ancien gouvernement Charest, certains étudiants ont
occupé le pavillon James, qui héberge
l’administration de l’université. Certains
d’entre eux sont entrés dans le bureau
de la directrice de l’université, Heather
Munroe-Blum, qui était alors absente.
Les policiers de l’escouade anti-émeute
sont ensuite intervenus et un protocole provisoire sur les manifestations et
l’occupation de l’université a été adopté.
Pour faire la lumière sur les événe-

ments et changer la manière d’intervenir
de l’université lors de ce type de situation, la principale Monroe-Blum a confié l’affaire au professeur Christopher
Manfredi. L’enseignant a émis un rapport en octobre dernier après avoir assisté à la tenue de quatre assemblées publiques sur la liberté d’expression. Dans
son rapport, Christopher Manfredi a,
entre autres, conclu qu’une révision du
Code de conduite de l’étudiant était
nécessaire.
Pour Eli Freedman, ce changement représente une atteinte à la liberté d’expression et à certains droits
de l’Homme. Il croit aussi que la modification aura un effet intimidateur et
que, s’il est adopté, il jettera un froid
sur les futures manifestations publiques
d’étudiants. «Avec ces modifications du
Code de conduite, les étudiants vont
certainement être moins enclins à manifester, car les conséquences seront plus
grave», déplore M. Freedman. Pour lui,
le protocole adopté après le 10 novembre 2011 est un symbole de la vision
de l’université des manifestations publiques, qui, selon lui, sont perçues
comme une menace: «Les manifestants
se sentent comme des terroristes sur leur
propre campus», dit-il.
L’étudiant qui termine son baccalauréat en philosophie a suivi les étapes du

protocole et lu le rapport Manfredi pour
enfin décider la semaine dernière d’aller
de l’avant et d’envoyer un grief contre la
modification de la loi au Sénat, prévue à
la fin du mois de janvier. «Je sens que plusieurs personnes me [soutiennent]. Or,
j’ai entrepris moi-même les démarches»,
a t-il affirmé au Délit, admettant avoir
reçu certains conseils juridiques gratuits

de certains avocats. Eli Freedman a donc
mis ses intentions sur papier, avec l’aide
de certains professeurs et espère avoir
un impact sur l’administration, même
s’il est très pessimiste à ce propos. Il
participera également à une manifestation contre la modification du Code de
l’étudiant de l’université qui aura lieu le
31 janvier prochain au Sénat. x
